Banciao District Prosecutors Office Press Release
Questioned by Mr. Chao, president of Chinese Professional Baseball League(CPBL), and Mr. Hong, chairman of Brother Elephants, about the violation of investigation secret investigation principle and failure to inform CPBL teams of players involvement in gambling and game fixing right in the beginning, leaving about the case more detrimental to CPBL and its teams, Banciao District Prosecutors Office makes the following clarification.
the sole spokesman at this office in charge of all public statements for the Baseball Game Fixing Scandal indicated that he completely followed the principle of this secret investigation and “Principle rules on press releases by the prosecutor offices, the police, and investigation institutes during the criminal investigation”, promulgated by Supreme Prosecutors Office. And under his consideration of maintaining public interests and protecting legal rights, press was appropriately released.  However, certain media intended to indirectly obtain the content of the investigation, by forcing this office to make clarification, unauthorized, inaccurate daily series of reports which were made in the name of “the prosecutor stated that …”, “the prosecutor and investigator disclosed that …”, etc., such as the prediction of the timing of the investigation on a specific person, what has been stated during the interrogation, the implication of a specific person involved, not only seriously misleads the public, but also brings along the misunderstandings that the principle of secret investigation has been violated by this office. In addition to disappointment of all this, this office hopes the media could give an undisturbed space for prosecutors to swiftly and accurately put the case to an end.
The ground of this case is the information received at the end of investigation process on Media T-Rex gambling case about a gangster clans manipulation on players to fix games, and prosecutors immediately initiated the investigation. During the initial stage, the evidence was indefinite; after collecting evidence and matching information over a long period of time, nevertheless, prosecutors gradually uncovered the course of the crime. In order to consolidate the evidence and trace the ringleader of this case, it was necessary to shun large-scale search actions right away. Furthermore, from the outset of an investigation process, prosecutors must strictly keep the content of the case unrevealed, or the punishment may rise according to criminal code. Therefore, it is impossible to inform CPBL and its teams. Mr. Hong misunderstood this.
