 How to Secure a Release on Bail or Suspend Detention without Bail (Trusted Delivery)

1. If a defendant is approved to be released on bail ,the bailiff will write a notice for payment. A relative of the defendant should present the notice to the service center(counter seven) to pay. The release is made upon sight of receipt.

2. Complete the bailing procedure:

    a. The defendant or a relative may complete the procedure.

    b. A relative may be informed by telephone, in writing or by other methods to come to the bailiff and complete the formalities.

3. Types of bail:

    (1) Bailed by individual.

      a. Find a person of integrity who resides in the office's jurisdiction and

      has a qualified occupation to serve as guarantor.

      b. Fill out a guarantee form.

      c. Sign or affix the personal seal or the fingerprint.

      d. Present the ID for verification.

      e. Present property ownership certificate.

   (2) Bailed with cash:

     a. The defendant or the guarantor may pay the designated amount in cash or valued security (calculated on the basis of current value).

     b. No guarantee paper is required.

     c. Pay guarantied cash. After office hours the office will assign someone to collect the money for delivery to the national treasury the next day.

4. Trusted delivery of the released defendant:

    a. The defendant must be delivered to his or her assistant, a proxy designated by the assistant, the senior relatives of the defendant or a person with decent occupation residing in the jurisdiction of the office.

     b. The designated person shall present his or her ID for verification, fill out a delivery form and affix a personal seal or fingerprint.

5. The defendant will be released upon the completion of the delivery procedure.

6. If a defendant who has a prosecutor's approval for release on bail can not complete the procedure on that day, he or she may petition the court for the release on bail.

7. The police will not collect any fee for processing, checking, and verifying the bail or for delivering the defendant.

8. Time limit for the process: A case is processed when it comes.
