File a Petition for Commutation of Imprisonment to a Fine

1.Under paragraph 1 of Article 41 of Taiwan Criminal Code (TCC), in an offense that carries a maximum principal punishment of not more than five years’ imprisonment, if the offender is sentenced to imprisonment for not more than six months or short-term imprisonment, the punishment may be commuted to a fine at a daily rate of one thousand, two thousand or three thousand New Taiwan Dollar (NTD). This provision does not apply to the cases in which the commutation of the pronounced punishment as imposed is manifestly of little corrective effect, or the legal order cannot be maintained.
2.If the sentenced person files a petition for commutation of imprisonment to a fine, the commutation of the fine in NTD and National Identification Card or equivalents should be presented to the case officer at this office in person before time limits.
3.As for the petition for commutation to a fine, except the proviso under paragraph 1 of Article 41 of TCC, the approval can be always made at this office, but to lobby is illegal and forbidden.
4. As regards filing a petition for commutation to a fine, if the sentenced person cannot return from abroad, is working on a deep-sea fishing vessel, or is suffered from a severe disease with prescription made by a physician, the case can be filed by the spouse, a third-degree blood relative, or a second-degree marital relative on behalf of the sentenced person.
