Directions for the Sentenced Person to Pay Fine by Installments

    Promulgated by Ministry of Justice on 13/9/1994

  1. If the sentenced person cannot afford to pay the fine in a lump sum, he or she may file a petition with the prosecutor for paying the fine by installments within two months after the final verdict.
     

  2. After receiving the petition for paying the fine by installments, the prosecutor may approve the fine to be paid in full installments, but the number of installments shall not be more than eight. The approval shall be made under the condition of the completion of installment payment before the statute of limitations.

  3.  Installment payments of the fine are monthly paid. If it is paid one month delayed by the sentenced person, the prosecutor may revoke the approval and a compulsory execution shall be ordered or the fine shall be commuted to labor service accordingly.

  4. Regarding the fine less than five thousand NTD, the sentenced person shall be normally ordered payment in full, but discretion to allow payment by installments is exceptional for whom in actual difficulty.

  5. As for the approval of payment by installments, the prosecutor ought to notify the sentenced person in writing or orally about the date and amount of each payment, and the consequence of delayed payments. If it is oral notification, the statement shall be clearly recorded.
     

  6. If the sentenced person is voluntary for questioning, no matter what the one is summoned or on the wanted list, the approval of fine payment by installments can be made without a bail bond. If the sentenced person is arrested with a warrant or on the wanted list, or commuted to labor service, the approval of payment by installments can be made only when the first installment is paid with a bail bond guaranteed by a reliable person.

  7. The above bail bond should specify that if the sentenced person absconds or pays irregularly, the signer shall take the responsibility of the full payment.

  8. After the office hours or on holidays, courts at all levels and the public prosecutor offices shall assign someone to collect fines.

  9. For the spouse, a third-degree blood relative, and a second-degree marital relative of the sentenced person who is arrested with a warrant or on the wanted list, or commuted to labor service, may check with the prosecutor for the amount of fines, and do the formalities of installment payments.

  10. When the sentenced person arrested on the wanted list is allowed to pay fines in installments, but thereafter fail to pay accordingly, the payment by installments shall not be approved for whom is arrested with a warrant or on the wanted list again.
