According to article 13 of Legal Aids Act and article 31, section 5 of the Code of Criminal Procedure, those who are indigent, mentally disabled, or indigenous may apply for legal aids. If the defendant is mentally disabled or indigenous, the prosecutor or police should inform the legal aid organization to send attorneys to represent the defendant.
