Q14:Why did my complaint lead to a case with a case number including the Chinese word “他”?

(1) In cases derived from complaint or report of a crime, if there is any of the following circumstances, the case number will include “他” rather than “偵”.

a. When the complainant or informer is unclear.

b. When the suspicion of criminal offense committed by specific person is unclear.

c. The complaint or report is filed by a person who used to file complaints or reports later proven to be untrue, or the accused has already been rendered “not guilty” by the courts or “not to prosecute” by the prosecutors and the ruling is final.

(2) In the following circumstances, the prosecutors may dismiss the case with an internal written report.

a. The informer is anonymous and the report fails to be concrete.

b. Repeated report of the same fact that is under investigation or has been decided in other cases.

c. According to the statement of fact or the report, there is obviously no relationship with the offense of crime.

d. The statement of fact or the report is fake, or impossible in experience.

e. The complaint is about public officials committing crimes when performing the duties, but there is no concrete allegation of fact which can constitute criminal offence, or no indication of evidence concerning the alleged crime.

f. The complaint or report is filed by a person who used to file complaints or reports later proven to be untrue, or the accused has already been rendered “not guilty” by the courts or “not to prosecute” by the prosecutors and the ruling is final.
